1. Acceptance of Terms

By accessing or using the services, software, or products provided by IBCTEC Ltd ("Company", "we", "us", "our"), you ("Client", "you", "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services.

2. Description of Services

IBCTEC Ltd provides custom software development, IT consultancy, system integration, cloud services, and ongoing technical support. Specific terms and deliverables will be outlined in individual project agreements or statements of work (SOWs).

3. Client Responsibilities

Clients agree to:

• Provide timely access to necessary information, systems, personnel, and resources.
• Ensure all content and materials provided are legally owned or licensed.
• Cooperate reasonably with IBCTEC Ltd during all stages of project development and delivery.

4. Payment Terms

Fees will be set out in individual contracts or invoices. Payments are due within [e.g., 30] days of the invoice date unless otherwise stated. Late payments may incur interest at [e.g., 2%] per month or the maximum amount allowed by law.

5. Intellectual Property

Unless otherwise agreed, all intellectual property created by IBCTEC Ltd during the course of service provision remains the property of IBCTEC Ltd until full payment is received. Upon full payment, ownership of bespoke software or deliverables may be transferred to the client as agreed in the contract.

6. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information and not disclose such information to third parties without prior written consent, except as required by law.

7. Data Protection

IBCTEC Ltd complies with the UK General Data Protection Regulation (UK GDPR). We will only use personal data provided by the client to deliver services or as required by law. Please see our Privacy Policy for more information.

8. What Information We Collect

We may collect the following information when you use the Marketme app or our services:

• Personal Information: Name, email address
• Location Data: User location (only when permission is granted and required for app functionality)
• Media Access: We will request access to your gallery and videos for creating campaigns only after explicit permission is granted by you
• Usage Data: App interactions, device type, operating system, crash logs, and engagement with push notifications
• Professional Information: Company name and role (if voluntarily provided)
• Payment Information: All payments are processed securely through PCI-DSS compliant payment gateways; we do not store your card details.
• Technical Data: IP address, browser type, device information, and app version
• Voluntary Information: Any additional information you choose to provide via forms, surveys, or email communications

Data Collection Compliance: All data collection practices comply with Apple App Store and Google Play Store guidelines. We only collect data that is necessary for app functionality and with appropriate user permissions. You can manage your privacy preferences and permissions through your device settings at any time.

9. Warranties and Disclaimers

IBCTEC Ltd will use reasonable efforts to provide services in a professional and workmanlike manner. All services are provided "as is" and we disclaim all warranties, express or implied, including merchantability or fitness for a particular purpose.

10. Limitation of Liability

To the fullest extent permitted by law, IBCTEC Ltd shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with the services, including but not limited to loss of profits, data, or goodwill.

11. Termination

Either party may terminate the agreement with [e.g., 30] days’ written notice. Upon termination, the client shall pay for all work completed up to the termination date.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.

13. Account Deletion & Subscription Management

Account Deletion: You can delete your account at any time by following these steps in the app: Go to Dashboard → Settings → Delete Account. Account deletion will permanently remove your data from our system.

Subscription Details:

• Our subscription plan "Marketme Premium" is billed at £25 per month
• Subscriptions automatically renew every month unless cancelled before the renewal date
• You may cancel your subscription at any time through:
  • Google Play Store (for Android users)
  • Apple App Store (for iOS users)
  • Your account settings within the app
• To avoid charges for the next billing cycle, cancellation must be completed at least 24 hours before the renewal date
• Subscription charges already processed are non-refundable, even after account deletion
• Refunds are subject to Apple App Store and Google Play Store refund policies

14. Mobile Application - Marketme (MME)

We offer a mobile application called "Marketme (MME)" available on iOS and Android platforms, which provides subscription-based marketing services.

Service Features:

• Free Trial: New users receive a 3-day free trial to explore premium features
• Subscription Cost: £25 per month after the trial period
• Auto-Renewal: Subscriptions automatically renew monthly unless cancelled
• Cancellation: Users may cancel or delete their account at any time without penalty
• Data Privacy: All personal data collected through the app is governed by this Privacy Policy and Terms of Service

Platform Compliance: Our app complies with Apple App Store and Google Play Store guidelines regarding subscription services, including clear pricing disclosure, easy cancellation processes, and transparent billing practices.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on our website with a revised effective date. Continued use of our services after changes are posted constitutes your acceptance of the new terms.
